General terms and conditions
Object of the contract
A. Kuster Sirocco AG sells goods offered in the e-shop or mobile app (hereinafter referred to as "eShop" or "website") to its clientele (hereinafter referred to as "Customer") under the following terms of delivery and sale.
The ordered goods can be shipped only to an address in Switzerland or the Principality of Liechtenstein. The merchandise offered for order on this website by A. Kuster Sirocco AG is within the limits of available stocks.
Conclusion of the contract
By ordering merchandise the Customer accepts the General Terms and Conditions which s/he acknowledged during the online ordering process in the e-shop.
The contract between the Customer and A. Kuster Sirocco AG comes into being with the placement of an order by the Customer and its acceptance by A. Kuster Sirocco AG as follows:
The Customer places the order via e-shop or e-mail. A. Kuster Sirocco AG accepts the order by supplying the merchandise ordered to the Customer.
A. Kuster Sirocco AG reserves the right to decline orders. Equally, the quantity of the merchandise ordered or to be ordered by the Customer from A. Kuster Sirocco AG on this website may be restricted.
Shipment
A. Kuster Sirocco AG delivers the merchandise to the address supplied by the Customer. If the delivery address is not the same as the invoice address it can be changed by the Customer in his/her shopping trolley or user account.
Merchandise ordered can only be shipped to an address in Switzerland or in the Principality of Liechtenstein. Depending on stocks, products will be shipped within two working days to the address specified by the customer.
Delivery conditions and shipping costs
No shipping costs are charged by A. Kuster Sirocco AG on orders over CHF 120 within Switzerland and the Principality of Liechtenstein.
For deliveries with a value below CHF 120, A. Kuster Sirocco AG will apply a fixed delivery charge of CHF 8 per order. This covers the costs of shipping, packaging and postage. If not all the items ordered can be delivered at once the costs of any subsequent delivery will be met by A. Kuster Sirocco AG.
Minimum order value: unfortunately, we cannot process any orders under CHF 30.
Products and prices
Catalog prices are shown in Swiss francs (CHF). Shipping costs are invoiced separately.
All product details received by the Customer as part of the offer in the (online) product catalog are non-binding. This particularly applies to modifications to product design and technology, which improve the product's functionality, as well as any errors in the product's description, illustrations and pricing details.
The prices shown are valid at the current time and include VAT but not shipping costs. Prices are subject to change without notice.
A. Kuster Sirocco AG reserves the right to change prices and delivery costs at any time and to cancel a contract in the event of typing, printing or calculation errors.
Discounts and promotions cannot be cumulated.
Right of return
The Customer has the right to return merchandise that fails to meet with expectations within a 14-day period after receipt.
A. Kuster Sirocco AG will accept the return of merchandise only if it is in its original condition and original packaging and accompanied by the invoice.
On return of the merchandise, A. Kuster Sirocco AG will refund the Customer the sale price of the returned item(s) including the shipping costs as stated in the invoice within 30 days of receipt of the returned merchandise.
The cost of returning the merchandise is borne by the Customer.
Password
When the Customer registers to make use of the services provided on this website, s/he will be requested to specify a password. The Customer must ensure this password remains completely confidential and not pass it on to third parties.
The Customer has exclusive responsibility for the use of this password and for any orders placed using this password, even without the Customer's knowledge.
Should the Customer become aware or suspect that a third party knows or is using their password, the Customer must inform A. Kuster Sirocco AG immediately. A. Kuster Sirocco AG is not liable for any damages resulting from the Customer's failure to provide this notification.
Inspection of merchandise
The Customer is responsible for checking the merchandise ordered when it arrives.
If the merchandise is damaged or incomplete the Customer must notify A. Kuster Sirocco AG of the defect within seven days of receipt of the item(s). In such cases, A. Kuster Sirocco AG will supply (an) equivalent replacement product(s). We cannot take into consideration complaints made later.
Warranty and guarantee
If the Customer has problems with a machine or questions relating to its operation or maintenance, A. Kuster Sirocco AG can be contacted by phone for advice and help.
If a phone call fails to produce a satisfactory solution, A. Kuster Sirocco AG provides a range of useful customer services. Please contact A. Kuster Sirocco AG by phone for further details.
All electrical appliances are covered by the manufacturer's guarantee for a period of 24 months after the date of purchase if no other warranty period is expressly stated. The guarantee becomes void if any modifications or repairs are made to the item without the written consent of A. Kuster Sirocco AG.
Furthermore, any claims for cancellation of sale or reduction in price are excluded. Compensation for damage will only be made in the case of externally visible damage to the product ordered and with written confirmation supplied by the applicable carrier.
Terms of payment
Private customers have the option of paying either by credit card, Post Finance card, invoice or TWINT.
For business clients listed in the Commercial Register, in addition to the aforementioned payment methods, we can supply against invoice for a minimum order value of CHF 120; the invoice will be sent by separate mail for settlement; payable within 30 days net. In the case of first orders over CHF 400, A. Kuster Sirocco AG reserves the right to supply only against advance payment.
Credit card payments are payable with immediate effect. Credit card payments are processed by our transaction service partners, Saferpay™ (See Data Protection).

Credit assessment and scoring
A.Kuster Sirocco AG reserves the right to obtain creditworthiness information about the customer in order to protect its own interests within the framework of the purchase transaction and may forward customer data to third parties for this purpose.
For this purpose, the personal data required for a creditworthiness check (first and last name as well as address data) will be transmitted to an external credit agency. CRIF AG, Hagenholzstrasse 81, 8050 Zurich, carries out a corresponding assessment of the creditworthiness based on mathematical-statistical procedures. The information obtained on the statistical probability of a payment default is included in the decision on the establishment, implementation or termination of the contractual relationship.
The creditworthiness check is carried out in compliance with the relevant provisions of data protection law and with special consideration for your interests worthy of protection. Please note that only CRIF AG can provide information on the data used to calculate your creditworthiness profile.
Purchase on account / reminder fees
The invoice is payable within 30 days. The invoice is paid on time if the amount owed is in the recipient's account by the end of the last day of the payment period.
If the payment deadline is not met and no fixed expiry date has been agreed, the customer shall be put in default of payment by means of a reminder. In the event of late payment, the defaulting customer will be charged interest on arrears of 5% plus reminder fees of CHF 25.-. If the claim is not settled even after a second/third reminder has been sent, A.Kuster Sirocco AG reserves the right to assign the claim to a third party or to commission the collection of the claim at the customer's expense.
Legal persecution/collection costs in the event of a delay in payment
The amount of the legal prosecution/collection costs is calculated on the basis of the outstanding claim:

Disclosure of personal data
Your personal data will be passed on to the transport company commissioned with the delivery or the corresponding financial service provider within the framework of the contract processing, insofar as this is necessary for the delivery or payment of the goods.
Retention of title
The merchandise remains the property of A. Kuster Sirocco AG until payment has been received in full. A. Kuster Sirocco AG has the right to make an entry in the Retention of Title Register (Eigentumsvorbehaltsregister) in respect of this. If the Customer falls in arrears with payment A. Kuster Sirocco AG has the right to reclaim the merchandise supplied.
Intellectual property
A. Kuster Sirocco AG reserves the rights to all graphics, text and photography used in its print and online media. The print and online media may not be copied or reproduced in full or in part unless for the purpose of submitting an order to A. Kuster Sirocco AG.
The name A. Kuster Sirocco AG and all logos are registered brand names or trademarks of A. Kuster Sirocco AG. All other trademarks, product names, or company names and logos cited in the print and online media are the sole property of the relevant entitled party.
A. Kuster Sirocco AG reserves the property rights and copyrights to all illustrations, drawings, calculations and other documents. The Customer may not forward these to any third party without the prior express permission of A. Kuster Sirocco AG.
Data protection
A. Kuster Sirocco AG is fully committed to protecting the personal data of its customers. Further information on the use of data by A. Kuster Sirocco AG is set forth in the relevant data protection provisions.
Limitations of liability
The contents, graphics and photographs on this website illustrate and describe A. Kuster Sirocco AG products solely for the purposes of providing information and involve no legal obligation. A. Kuster Sirocco AG assumes no liability for errors or omissions in the content published on this website.
A. Kuster Sirocco AG hereby excludes any liability, to the maximum extent permitted by law. In particular, A. Kuster Sirocco AG assumes no liability for damage arising from defects or damage resulting from improper use or natural wear and tear.
Siroccoclub
After successful login in the online shop or mobile app, we grant you a 3% reduction in the entire shopping cart. Vouchers and gift cards are excluded. Discounts cannot be cumulated.
General Membership Conditions:
- To become a SiroccoClub member, you must first register as a Sirocco Customer through the online shop or the mobile app.
- Persons under the age of 18 are excluded from membership.
- A legal claim to membership in the SiroccoClub program is excluded.
- Customers resident in Switzerland or the Principality of Liechtenstein are eligible for membership.
You will receive regular information about promotions and events through the following communication channels: regular mail, e-mail, telephone and mobile means of communication (e.g. smartphone).
Membership in the SiroccoClub can be cancelled in writing at any time. SiroccoClub membership will also be cancelled if you no longer agree to the processing of personal data.
Force majeure
A. Kuster Sirocco AG assumes no liability if a delivery is delayed or rendered unfeasible by circumstances beyond the control of A. Kuster Sirocco AG, including strike, war, natural disasters or similar circumstances which may prevent or hinder production, transportation or delivery.
Place of jurisdiction and applicable law
These General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are exclusively subject to Swiss law.
The place of jurisdiction is at the headquarters of A. Kuster Sirocco AG.
Final provisions
Only the General Terms and Conditions valid at the time of the conclusion of contract shall apply. These General Terms and Conditions supersede any of the Customer's own terms and conditions. Should any individual provisions of these Terms and Conditions be or become invalid, the validity of the other terms shall in no way be affected.
A. Kuster Sirocco AG reserves the right to amend the Terms and Conditions at any time. The amended version will be published on this website. By placing an order subsequent to the revision, the Customer agrees to the amendments.
